Overview

Developers Stack Inc. ("Developers Stack") respects intellectual property rights and complies with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"). This policy outlines the procedure by which copyright owners, or their authorised agents, may notify Developers Stack of alleged copyright infringement on our Platform.

As a platform hosting user-generated and instructor-created content, Developers Stack qualifies for the "safe harbour" protections under the DMCA as an online service provider, provided we respond expeditiously to valid takedown notices and comply with the other requirements of the DMCA.

Important: Before filing a DMCA takedown notice, please be aware that submitting a false, misleading, or bad-faith notice may expose you to legal liability, including damages and attorneys' fees under 17 U.S.C. § 512(f).

Filing a Takedown Notice

If you believe that content on Developers Stack infringes your copyright, you may submit a DMCA takedown notice ("Notice") to our designated DMCA Agent. Your Notice must comply with the requirements of 17 U.S.C. § 512(c)(3), as described in the next section.

Upon receipt of a valid Notice, Developers Stack will:

  1. 1Promptly remove or disable access to the allegedly infringing content.
  2. 2Notify the user or content provider that the material has been removed.
  3. 3Provide the user with a copy of the takedown notice (with your personal contact information redacted where required by law).
  4. 4Inform the user of their right to submit a counter-notice.

Required Notice Elements

To be valid under the DMCA, your takedown notice must include all of the following elements:

Physical or Electronic Signature

A physical or electronic signature of the person authorised to act on behalf of the owner of the copyright interest.

Identification of the Copyrighted Work

A description of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered, a representative list.

Identification of the Infringing Material

A description of the material claimed to be infringing, with sufficient information for Developers Stack to locate it (e.g. the URL of the infringing page).

Contact Information

Your name, address, telephone number, and email address so Developers Stack may contact you.

Good Faith Statement

A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.

Accuracy Statement

A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

Send your completed Notice to our DMCA Agent at dmca@developersstack.com. Incomplete notices may not be processed.

Counter-Notice Procedure

If your content was removed due to a DMCA takedown notice and you believe the removal was incorrect or the result of a mistake or misidentification, you may submit a counter-notice to our DMCA Agent.

A valid counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and its original location on Developers Stack.
  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or San Francisco, CA if outside the US).
  • A statement that you will accept service of process from the person who filed the original DMCA notice.

Upon receipt of a valid counter-notice, Developers Stack will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, your content may be restored.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Developers Stack has adopted a policy of terminating, in appropriate circumstances and at Developers Stack's sole discretion, the accounts of users who are deemed to be repeat infringers.

Developers Stack may also, at its sole discretion, limit access to the Platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

For instructors, a single confirmed infringement may result in the removal of the infringing course and a formal warning. A second confirmed infringement may result in permanent removal from the instructor programme without refund of accrued royalties.

Good Faith & Misuse

The DMCA provides that any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed by mistake or misidentification, may be subject to liability (17 U.S.C. § 512(f)).

Developers Stack reserves the right to seek damages from any party that abuses the DMCA process. Submitting a takedown notice for content that you know is not infringing — for example, to suppress competition or remove lawful criticism — constitutes misuse of the DMCA process.

Limitations & Safe Harbour

Developers Stack stores and transmits content at the direction of users and instructors. We do not monitor content for potential copyright infringement and are not responsible for user-submitted content. Our DMCA safe harbour protections apply to content stored at the direction of users under 17 U.S.C. § 512(c).

Safe harbour protections do not apply to content that Developers Stack creates itself, to content for which Developers Stack has received a financial benefit directly attributable to the infringing activity, or to situations where Developers Stack has actual knowledge of infringement and fails to act expeditiously.
